{"id":1015,"date":"2021-10-08T15:18:16","date_gmt":"2021-10-08T15:18:16","guid":{"rendered":"https:\/\/www.h1btransfersusa.com\/blog\/?p=1015"},"modified":"2021-10-08T15:21:12","modified_gmt":"2021-10-08T15:21:12","slug":"good-news-for-h-1b-visa-holders-stranded-in-india","status":"publish","type":"post","link":"https:\/\/www.h1btransfersusa.com\/blog\/good-news-for-h-1b-visa-holders-stranded-in-india\/","title":{"rendered":"Good news for H-1B visa holders stranded in India"},"content":{"rendered":"\n<p>H-1B Visa Holders: A US district court judge has <strong>prohibited <\/strong>the use of travel bans as an excuse to not process or give visas, like <strong>H-1Bs \u2013 a non-immigrant visa.<\/strong><\/p>\n\n\n\n<p>While the US is gearing up to open its doors from <strong>November <\/strong>to fully vaccinated travelers, this decision by the district court of Columbia, articulated on <strong>5th October<\/strong> is good news for those holding H-1Bs and their dependents, (for example, <strong>spouses holding H4 visas<\/strong>) who had found up themselves stranded in India while visiting their family.<\/p>\n\n\n\n<p>Individuals who were allotted <strong>H-1Bs<\/strong> under the lottery mechanism also observed themselves not be able to get their <strong>visas <\/strong>processed.<\/p>\n\n\n\n<p>Travel bans were imposed under a <strong>Presidential Proclamation<\/strong> earlier by previous President Donald Trump and later by President <strong>Joe-Biden<\/strong>. The fallout was that <strong>visa processing<\/strong> came to halt. No nonimmigrant visas were given, except if the individual could claim a &#8216;National Interest Exemption&#8217; \u2013 a challenging task.<\/p>\n\n\n\n<p>On 30th April, Biden had given a proclamation restricting the entry of <strong>non-immigrants<\/strong> (green-card holders were absolved from the ban) who were physically present within India during the <strong>14-day period <\/strong>preceding their entry or attempted entry into the <strong>US<\/strong>.<\/p>\n\n\n\n<p>We had earlier reported about the <strong>filing of a claim <\/strong>by a few people, including Indian nationals. &#8220;A few plaintiffs are long-term employees of <strong>US companies<\/strong>, who have been stuck outside of the US and whose careers are in danger as they can&#8217;t get back to their jobs, homes, and networks. All individual plaintiffs have experienced <strong>extra costs<\/strong>, undue stress, and frustration. While awaiting the Department of State\u2019s resumption of <strong>non-immigrant visa processing<\/strong>,\u201d stated the lawsuit.<\/p>\n\n\n\n<h2>H-1B Visa Holders Stranded in India<\/h2>\n\n\n\n<p>The submitted before the<strong> district court<\/strong> that the US Department of State \u2018has refused to process their <strong>non-immigrant visas<\/strong>\u2019.  To \u2018schedule interviews or adjudicate their <strong>visa applications<\/strong>, or &#8216;to give the visas&#8217; because of the Presidential Proclamation. They also pointed out that \u201cconsular officials are <strong>categorically <\/strong>precluded from processing their visa applications. Except if they fall under an exemption, regardless of the capacity and <strong>reopening status<\/strong> of local consulates and embassies\u201d.<\/p>\n\n\n\n<p>While Judge James E. Boasberg didn&#8217;t order the <strong>US Department of State<\/strong> to quickly adjudicate the suit. He has debarred the use of the travel ban proclamation as an excuse to refuse <strong>visa processing<\/strong>.<\/p>\n\n\n\n<h4 class=\"has-text-align-right\">[<a href=\"https:\/\/www.h1btransfersusa.com\/blog\/us-cannot-stop-issuing-visas-during-travel-bans-federal-judge-rules\/\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"has-inline-color has-vivid-purple-color\">The US Cannot Stop Issuing Visas During Travel Bans, Federal Judge Rules<\/span><\/a>]<\/h4>\n\n\n\n<p>Greg Siskind, one of the <strong>immigration lawyers<\/strong> who is addressing the plaintiffs, said: &#8220;This is a lovely important win for us since it [the lawsuit] was specifically aimed at killing the <strong>illegal interpretation<\/strong> across the board and not only for the plaintiffs. This will also hopefully bar a President in the future from abusing this power.\u201d<\/p>\n\n\n\n<p>Charles Kuck, another immigration lawyer representing the <strong>plaintiffs <\/strong>added. &#8220;We are thankful that Judge Boasberg saw through the cascade of ridiculous<strong> legal affirmatively rule<\/strong> that it is a violation of federal law to refuse to issues visas solely. Because a President has proclaimed an entry ban under the <strong>Immigration and Nationality Act &#8211; 212(f)<\/strong>. We approach the Department of State to now get rid of its ridiculous and legally unnecessary <strong>national interest exemption program<\/strong>. And return to the business of visa issuance all throughout the world regardless of those <strong>entry bans<\/strong>.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>H-1B Visa Holders: A
