{"id":1224,"date":"2021-12-30T14:56:33","date_gmt":"2021-12-30T14:56:33","guid":{"rendered":"https:\/\/www.h1btransfersusa.com\/blog\/?p=1224"},"modified":"2021-12-30T14:56:34","modified_gmt":"2021-12-30T14:56:34","slug":"3-5-lakh-indians-currently-stuck-in-green-card-backlog","status":"publish","type":"post","link":"https:\/\/www.h1btransfersusa.com\/blog\/3-5-lakh-indians-currently-stuck-in-green-card-backlog\/","title":{"rendered":"3.5 lakh Indians currently stuck in Green Card backlog"},"content":{"rendered":"\n<p>Around <strong>357,720 Indians<\/strong> have not been able to finish their applications for an<strong> employment-based green card <\/strong>however they have been processed, because of the <strong>green card backlog <\/strong>currently, information released by the US Citizenship and Immigration Services (<strong>USCIS<\/strong>) showed.<\/p>\n\n\n\n<p>This is almost <strong>eight times <\/strong>higher than China, which ranks second with <strong>46,926<\/strong> such candidates.<\/p>\n\n\n\n<p>&#8220;These are the principal candidates who have an approved<strong> I-140<\/strong> and are waiting to either file their <strong>I-485 application<\/strong> or who might have filed using the filing chart, yet their priority dates are not currently under the final action chart,&#8221; said Nandini Nair, partner at Greenspoon Marder, a law office.<\/p>\n\n\n\n<p>When the I-140, or <strong>initial petition <\/strong>for residency, is approved, the candidates can file for an adjustment of status.<\/p>\n\n\n\n<p>&#8220;There is a substantial backlog for <strong>Indian nationals <\/strong>as they are the highest percentage of candidates for the employment-based green card,&#8221; Nair said. &#8220;The line is so astronomically huge, that without <strong>Congressional <\/strong>intervention to fix the work employment-based <strong>green card system<\/strong>, a critical part of these candidates may not receive their green cards in their lifetime.&#8221;<\/p>\n\n\n\n<h2>3.5 Lakhs of Indians Stuck in Green Card Backlog<\/h2>\n\n\n\n<p>Organizations often sponsor <strong>permanent residency<\/strong> for employees to hold on to high-skilled labor. In recent years, American technology organizations including Facebook,<strong> Google, Amazon<\/strong>, and Cognizant have arisen as some of the top sponsors of green cards for their employees, as indicated by <strong>USCIS data<\/strong>.<\/p>\n\n\n\n<p>Over time, slow processing coupled with <strong>high demand<\/strong> has resulted in an increased backlog for Indian candidates. Every year, the United States issues <strong>140,000 green cards<\/strong>, subject to a <strong>7% <\/strong>per-country limit.<\/p>\n\n\n\n<p>&#8220;Constant and unreasonable delays have become an <strong>integral part <\/strong>of the USCIS and other <strong>immigration processes<\/strong>\u2026,&#8221; said Rajiv S Khanna, managing lawyer at Immigration.com. &#8220;While we can understand some delays that have been built into the process by rule. For example, country-based immigration, <strong>processing delays<\/strong> of a year or more in benefits. That should require only minutes to adjudicate are uncivilized.&#8221;<\/p>\n\n\n\n<p>Organizations and <strong>pro-immigration<\/strong> lawmakers have been calling for <strong>immigration reform<\/strong>. Because it would help the US retain high-skilled talent and aid the local economy.<\/p>\n\n\n\n<h4 class=\"has-text-align-right\">[<a href=\"https:\/\/www.h1btransfersusa.com\/blog\/u-s-to-waive-visa-interviews-for-h1b-f-m-h3-l-o-p-q-h2b-through-2022\/\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"has-inline-color has-vivid-cyan-blue-color\">US to waive in-person interviews for H-1B, other visas through 2022 to reduce wait times<\/span><\/a>]<\/h4>\n\n\n\n<p>However, most attempts at bringing about regulatory change have not made it through the <strong>US Congress<\/strong>.<\/p>\n\n\n\n<p>&#8220;While Congress is completely aware of the issues, little has been done to correct the situation. For a country that <strong>claims <\/strong>to be a country of <strong>immigrants<\/strong>. The disregard for its own needs served by immigration is emblematic of our systemic dysfunction,&#8221; said Khanna.<\/p>\n\n\n\n<p>Most recently, the Build Back Better Bill has proposed substantial <strong>immigration change<\/strong>. It has been passed by the US House of Representatives yet should be cleared by the <strong>Senate <\/strong>before it can become law.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Around
