{"id":1352,"date":"2022-02-16T10:28:27","date_gmt":"2022-02-16T10:28:27","guid":{"rendered":"https:\/\/www.h1btransfersusa.com\/blog\/?p=1352"},"modified":"2022-02-16T10:28:28","modified_gmt":"2022-02-16T10:28:28","slug":"preliminary-settlement-provides-relief-to-former-unnj-students","status":"publish","type":"post","link":"https:\/\/www.h1btransfersusa.com\/blog\/preliminary-settlement-provides-relief-to-former-unnj-students\/","title":{"rendered":"Preliminary Settlement Provides Relief to Former UNNJ Students"},"content":{"rendered":"\n<p>A U.S. federal district court approved a <strong>preliminary settlement agreement<\/strong> for previous students of the University of Northern New Jersey (UNNJ), a fictitious university created by the U.S. Department of Homeland Security (DHS) in 2012. Following the closure of <strong>UNNJ in 2016<\/strong>, the DHS terminated the <strong>F-1 status<\/strong> of students enrolled at the school, and in a few cases made findings of fraud and misrepresentation resulting in permanent inadmissibility against many <strong>UNNJ students<\/strong>.<\/p>\n\n\n\n<p>The settlement agreement stems from a<strong> lawsuit filed<\/strong> in 2016 by previous UNNJ students who believed that the government&#8217;s blanket policy of ending students&#8217;<strong> F-1 status<\/strong> and making inadmissibility decisions without conducting individual hearings violated the law. Pursuant to the proposed settlement agreement, previous <strong>UNNJ students<\/strong> will be protected from facing negative consequences. Including denials of <strong>immigration benefits<\/strong>, solely because of their enrollment at UNNJ.<\/p>\n\n\n\n<h3>Terms of the Settlement Agreement<\/h3>\n\n\n\n<p>The settlement agreement defines a class member as &#8220;any noncitizen who, for any period of time, enrolled in the University of Northern <strong>New Jersey<\/strong>.&#8221; As such, even if a student only enrolled at UNNJ for a very brief period, that student would be protected under this <strong>settlement<\/strong>. The full terms of the proposed settlement agreement have been posted on the U.S. Citizenship and Immigration Services (<strong>USCIS<\/strong>) site in order to notify potential class members. The notice of the proposed <strong>class action settlement<\/strong> outlines all the applicable terms. Notably, under the proposed settlement agreement, the <strong>U.S. government<\/strong> has agreed to the following terms:<\/p>\n\n\n\n<h2>Relief to Former UNNJ Students<\/h2>\n\n\n\n<ul><li>It won&#8217;t depend on a <strong>student&#8217;s enrollment <\/strong>at UNNJ as the main reason to find a previous UNNJ student deportable or inadmissible.<\/li><li>It won&#8217;t deny an<strong> immigration benefit<\/strong> to a previous UNNJ student based only on earlier enlistment at UNNJ. What&#8217;s more, if previous UNNJ students were already denied an immigration benefit. That denial should not negatively impact the<strong> student&#8217;s future applications <\/strong>for immigration benefits.<\/li><li>Previous UNNJ students can retract an<strong>y UNNJ-related <\/strong>misrepresentations made prior to the 2016 closure of the university. If a <strong>UNNJ student <\/strong>made any misrepresentation relating to enrollment at UNNJ. The student can retract or correct this misrepresentation in a later filing, application, or interview. If the statement is withdrawn, the government can&#8217;t think about the statement \u201cmaterial\u201d to support a finding of inadmissibility due to fraud or <strong>misrepresentation<\/strong>.<\/li><li><strong>DHS <\/strong>will dismiss removal proceedings against previous UNNJ students. And reopen and dismiss <strong>removal proceedings<\/strong> for any previous UNNJ students who the DHS eliminated because of enrollment at UNNJ.<\/li><li>The DHS will consider previous UNNJ students to be in lawful <strong>immigration status<\/strong> from the date of enrollment at UNNJ through 180 days. After the Court approves the last Settlement, or<strong> 180 days <\/strong>after removal proceedings are ended, if applicable.<\/li><li>DHS will assist applications for<strong> immigration benefits<\/strong> filed during the time periods mentioned in point 5.<\/li><li>The DHS will remove references to &#8220;fraud&#8221; including any discoveries of fraud-related inadmissibility. From <strong>former UNNJ\u2019s record<\/strong> that arose solely from enrollment at UNNJ.<\/li><\/ul>\n\n\n\n<p>The proposed settlement agreement also outlines <strong>obligations <\/strong>for each class member. Including the requirement that class members without l<strong>awful status <\/strong>submit an application to obtain legal status. Or depart the U.S. within 180 days from the date the court approves the <strong>settlement agreement<\/strong>.<\/p>\n\n\n\n<h3>Timeline for Finalizing Agreement<\/h3>\n\n\n\n<p>The deadline for any class member to object to the settlement agreement is <strong>4th April 2022<\/strong>, and the court will hold a fairness hearing on <strong>2nd May 2022.<\/strong> If the court approves the settlement agreement, the agreement will be effective as of the<strong> date of approval<\/strong>.<\/p>\n\n\n\n<h4 class=\"has-text-align-right\">[<a href=\"https:\/\/www.h1btransfersusa.com\/blog\/uscis-encourages-green-card-filings-in-eb-1-and-eb-2-categories\/\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"has-inline-color has-vivid-purple-color\">USCIS Encourages Green Card Filings in EB-1 and EB-2 Categories<\/span><\/a>]<\/h4>\n\n\n\n<h3>Conclusion<\/h3>\n\n\n\n<p>Whenever concluded this <strong>settlement students <\/strong>will greatly benefit previous UNNJ students who have faced denials requests since the UNNJ shut in 2016. While the settlement only applies to <strong>previous UNNJ students<\/strong>. There are other continuous claims pertaining to former students of Farmington University. Which was one more college created by the <strong>DHS<\/strong>.
