The rule was eventually blocked by several federal courts.<\/p>\n\n\n\n<h3>Overview of Proposed Rule on \u201cPublic Charge\u201d with Examples<\/h3>\n\n\n\n<p>The <strong>proposed rule<\/strong> returns the definition of &#8220;public charge&#8221; to the 1999 definition. Prior to the implementation of the <strong>Trump Administration&#8217;s<\/strong> 2019 public charge rule, the DHS depended on the 1999 Interim Field Guidance on Deportability and Inadmissibility on Public Charge Grounds to define <strong>public charge<\/strong>. This guidance is defined as a person who is \u201cprimarily dependent on the government for subsistence, as shown by either the receipt of public cash assistance for<strong> income maintenance<\/strong> or institutionalization for long-term care at government expense.\u201d<\/p>\n\n\n\n<p>Instances of public charge under the proposed rule include the following:<\/p>\n\n\n\n<ul><li>Supplemental Security Income (SSI)<\/li><li>Cash help for income maintenance under the Temporary Assistance for Needy Families <strong>(TANF) program<\/strong><\/li><li>State, tribal, territorial, and local cash help for income maintenance<\/li><li><strong>Long-term<\/strong> institutionalization at government expense<\/li><\/ul>\n\n\n\n<h3>Exemptions from Public Charge with Examples<\/h3>\n\n\n\n<p>Furthermore, the proposed rule explicitly expresses that receipt of a few commonly used <strong>public benefits <\/strong>is not considered while making a public charge determination. some of these exempted benefits include the following:<\/p>\n\n\n\n<ul><li>Food and nutrition help programs including the Supplemental Nutrition Assistance Program <strong>(SNAP)<\/strong><\/li><li>Kids&#8217; Health Insurance Program<\/li><li>Most Medicaid benefits (except for long-term institutionalization at government expense)<\/li><li>Housing benefits<\/li><li>Transportation vouchers<\/li><li>Disaster assistance received under the Stafford Act<\/li><li>Pandemic assistance<\/li><li>Further, benefits received via a tax credit or deduction<\/li><li>Social Security<\/li><li>Government pensions or other earned benefits<\/li><\/ul>\n\n\n\n<h4 class=\"has-text-align-right\">[<a href=\"https:\/\/www.h1btransfersusa.com\/blog\/us-congress-revives-eb-5-regional-center-program-minimum-investment-sum-stands-hiked-to-800000\/\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"has-inline-color has-luminous-vivid-orange-color\">US Congress revives EB-5 regional center program<\/span><\/a>]<\/h4>\n\n\n\n<h3>Conclusion<\/h3>\n\n\n\n<p>The proposed public charge rule under the<strong> Biden Administration<\/strong> adjusts the desire to save the United States.
