The United States Citizenship and Immigration Services (USCIS<\/strong>) has announced that next month, it will accept employment-based adjustment of status applications<\/strong> with priority dates that are earlier than the Final Action Dates chart in the State Department’s April Visa Bulletin 2023<\/strong>. This follows several months of the agency accepting adjustment of status applications according to the more generous Filing Dates chart<\/strong>.<\/p>\n\n\n\n

April 2023 Visa Bulletin Summary<\/h2>\n\n\n\n

According to the Visa Bulletin of April 2023<\/strong>, Final Action cutoff dates for the issuance of an immigrant visa <\/strong>and filing or approval of an adjustment of status application will be as follows:<\/p>\n\n\n\n

Employment-Based, First Preference (EB1) Category<\/h3>\n\n\n\n

However, there is no movement in the EB1 category,<\/strong> with China and India maintaining their 1st February 2022<\/strong>, cutoff dates. The category remains current for all chargeability nations.<\/p>\n\n\n\n

Employment-Based, Second Preference (EB2) Category<\/h3>\n\n\n\n

Except for EB2 China’s cutoff date, which stays unchanged on 8th June 2019<\/strong>, the EB2 cutoff dates all retrogress. Moreover, the EB2 India cutoff date has been moved back to 1st January 2011<\/strong>. For any remaining nations of chargeability, the EB2 cutoff date retrogresses to 1st July 2022<\/strong>.<\/p>\n\n\n\n

Employment-Based, Third Preference (EB3) Category<\/h3>\n\n\n\n

The only movement in the EB3 category is that China\u2019s cutoff date advances to 1st November 2018. Also, the cutoff date for EB3 India<\/strong> remains 15th June 2012<\/strong>. For all other countries with chargeability, the EB3 category remains current.<\/p>\n\n\n\n

EB3 Other Workers<\/h2>\n\n\n\n

The cutoff date for EB3 workers in China moves up to 1st October 2014<\/strong>. Also, there is no other movement in this category, with India maintaining a cutoff date of 15th June 2012<\/strong> and all other nations maintaining a cutoff date of 1st January 2020.<\/p>\n\n\n\n

Employment-Based, Fourth Preference (EB4) Category<\/h3>\n\n\n\n

In April, all nations of chargeability have a cutoff date of 1st September 2018<\/strong>, in the EB4 category.<\/p>\n\n\n\n

Employment-Based, Fifth Preference (EB5) Category<\/h3>\n\n\n\n

There is no movement in the EB5 category. China\u2019s cutoff date for EB5 unreserved (i.e., EB5 immigrant visa <\/strong>numbers not set aside for rural, high unemployment, and infrastructure projects) remains set at July 8, 2015, while India keeps a June 1, 2018 <\/strong>cutoff date. EB5 stays current for any remaining EB5 categories and nations of chargeability.<\/p>\n\n\n\n

Family-Based, Second Preference, A (FB2A)<\/h3>\n\n\n\n

In April, the FB2A category<\/strong>, which is reserved for spouses and children of lawful permanent residents, retrogresses significantly. The FB2A cutoff date for Mexico has been set for 1st November 2018<\/strong>. Also, September 8, 2020, cutoff date is set for any remaining nations of chargeability.<\/p>\n\n\n\n
