Facebook was among the main five recipients of all-new <strong>H-1B visas<\/strong> gave in FY2019. As indicated by information from US Citizenship and Immigration Services (<strong>USCIS<\/strong>). The positions that subject to Facebook&#8217;s alleged discrimination against <strong>U.S. workers <\/strong>offered an average salary of approximately <strong>$156,000<\/strong>, said the Justice Department, in a press release.<\/p>\n\n\n\n<p>The <strong>Department of Justice&#8217;s<\/strong> claim alleges that Facebook engaged in intentional and widespread <strong>violations <\/strong>of the law. By setting aside positions for temporary visa holders as opposed to considering interested and qualified U.S. workers, said Assistant Attorney General Eric S. Dreiband of the Civil Rights Division. This claim follows an almost <strong>two-year<\/strong> investigation into Facebook\u2019s practices. And a \u2018reasonable cause\u2019 determination by the Justice Department\u2019s <strong>Civil Rights Division<\/strong>.<\/p>\n\n\n\n<p>Our message to workers is clear: if organizations deny employment openings by <strong>illegally preferring <\/strong>temporary visa holders. The Department of Justice will hold them responsible. Our message to <strong>all employers<\/strong> \u2014 including those in the technology area \u2014 is clear: you can&#8217;t illegally prefer to recruit, consider, or <strong>hire temporary <\/strong>visa holders over U.S. workers.<\/p>\n\n\n\n<p>In recent years, American tech organizations have arisen as the greatest clients of the <strong>H-1B and PERM programs.<\/strong><\/p>\n\n\n\n<h2 class=\"has-text-align-center\">H-1B Visa Workers<\/h2>\n\n\n\n<p>The department\u2019s lawsuit alleges that from <strong>Jan 2018 to Sep 2019<\/strong>, Facebook employed tactics that oppressed U.S. workers and routinely preferred temporary visa holders (including <strong>H-1B visa holders<\/strong>)for occupations regarding the PERM process. Facebook tried to channel jobs to temporary visa holders at the expense of<strong> US workers <\/strong>by failing to promote those opening on its professions site, expecting candidates to apply by physical mail only, and refusing to consider any U.S. workers who applied for those positions. <\/p>\n\n\n\n<p>Interestingly, Facebook&#8217;s usual <strong>hiring process<\/strong> depends on recruitment methods. Designed to encourage applications by promoting positions on its careers site. During a similar time period typically attracted <strong>100 <\/strong>or more candidates each.<\/p>\n\n\n\n<p>The release said that these practices also have <strong>adverse consequences<\/strong> on temporary visa holders.
