The US Department of Homeland Security has published a final rule<\/strong> in the Federal Register to make changes to the H-1B visa process.<\/strong> A move that will affect how the visa lottery is done in March<\/strong> this year. The rule replaces the random H-1B selection process<\/strong> with a wage-based selection process. However, legal counselors said that President-Elect Joe Biden<\/strong> could cancel or postpone the execution of the rule.<\/p>\n\n\n\n

According to the new rule<\/strong>, applications would be selected based on the highest Occupational Employment Statistics (OES<\/strong>) prevailing wage level. That the proffered wage equals<\/strong> or exceeds for the relevant Standard Occupational Classification (SOC<\/strong>) code and area(s) of intended employment. The rule would be effective within 60 days<\/strong> of publication.<\/p>\n\n\n\n

H-1B Selection Process<\/h2>\n\n\n\n
