Each kind of action requires an alternate sort of approach for <strong>reversal<\/strong>.<\/p>\n\n\n\n<h2>Reversing Regulations, Policy, Executive Orders<\/h2>\n\n\n\n<p>On January 20, The White House Chief of Staff gave a <strong>memorandum <\/strong>that directs the <strong>agencies <\/strong>to take some actions and \u201cconsider\u201d (a nicer way of saying &#8211; do it) certain others.<\/p>\n\n\n\n<p>The following rules and policies will be changed:&nbsp;<\/p>\n\n\n\n<ul><li>The rule requiring the selection of <strong>H-1B workers<\/strong> based upon the highest salary &#8211; FROZEN for <strong>60 days<\/strong> (until March 21, 2021) or more.&nbsp;<\/li><li>The rule redefining e<strong>mployer-employee <\/strong>relationships for H-1B purposes &#8211; WITHDRAWN.<\/li><li>The Department of Labor (DOL) policy requiring end customers to be involved in and take responsibility for the <strong>H-1B process<\/strong> &#8211; should be WITHDRAWN.<\/li><\/ul>\n\n\n\n<p>Biden also signed an executive order reversing the <strong>ban on travel<\/strong> from certain Muslim nations. The <strong>immigration ban<\/strong> that Trump had extended to <strong>March 31, 2021<\/strong>, is not withdrawn yet.<\/p>\n\n\n\n<p>To attempt the reversal of rules and policy, on<strong> January 20, 2021<\/strong>, the White House Chief of Staff gave an update that <strong>guides<\/strong> the agencies to:&nbsp;<\/p>\n\n\n\n<ul><li>Freeze making of or publication of all new <strong>guidelines<\/strong>.&nbsp;<\/li><li>The Freeze publication of rules that have not yet been published.&nbsp;<\/li><li>Freeze for 60 days (until <strong>31 March 2021<\/strong>) the rules that have been published, however, have not yet taken effect, stating further for the agencies to:<\/li><li>a) consider opening a <strong>30-day<\/strong> comment period to permit interested parties to give comments about <strong>issues <\/strong>of fact, law, and policy raised by those rules.&nbsp;<\/li><li>b) consider pending <strong>petitions <\/strong>for reconsideration involving such rules.<\/li><li>c) where necessary to continue to review these questions of fact, law, and policy, and consider further delaying, or publishing for notice and comment proposed rules further delaying, such rules beyond the <strong>60-day period.<\/strong><\/li><li>d) undertake further <strong>deliberation <\/strong>before taking any action on or under those rules that raise substantial questions of fact, law, or policy.<\/li><\/ul>\n\n\n\n<h3>Reversing Trump&#8217;s Damage on H-1B &amp; Reforming Immigration Laws<\/h3>\n\n\n\n<p>The Biden Administration has also sent a<strong> legislative package<\/strong>. The detailed <strong>documentation<\/strong> isn&#8217;t available yet, however the package of proposed changes includes the following:&nbsp;<\/p>\n\n\n\n<ul><li>Clearing employment-based <strong>green card<\/strong> backlogs, and eliminating per-country visa caps&nbsp;<\/li><li>Making it simpler for graduates of <strong>U.S<\/strong>. universities with advanced Science, Technology, Engineering, and Mathematics (<strong>STEM)<\/strong> degrees to stay in the United States<\/li><li>Continue to give dependents of <strong>H-1B visa holders<\/strong> work authorization<\/li><li>Preventing youngsters from &#8220;aging out&#8221; of the system when they turn<strong> 21 years<\/strong> old&nbsp;<\/li><li>Creating a <strong>pilot program<\/strong> to stimulate regional economic development, authorizing the <strong>USCIS<\/strong> to adjust green cards based on macroeconomic conditions<\/li><li>Incentivizing higher wages for <strong>non-immigrant<\/strong>, high-skilled visas (like H-1B) to prevent unfair competition with American workers<\/li><li>Providing simpler routes for <strong>foreign students<\/strong> who get US STEM degrees<\/li><\/ul>\n\n\n\n<p>Politically, this is a good time for<strong> immigration laws<\/strong> to be redone and modernized. Closing from <strong>different polls<\/strong> conducted over the last two years. <strong>70% <\/strong>of the US population considers immigration to be important for the United States. Democrats, that is <strong>Biden&#8217;s party,<\/strong> have the majority part (although a slim one) to pass laws and be effective.<\/p>\n\n\n\n<h4 class=\"has-text-align-right\">[<a href=\"https:\/\/www.h1btransfersusa.com\/blog\/us-to-set-up-a-new-unit-to-probe-possible-misuse-of-student-work-permits\/\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"has-inline-color has-vivid-cyan-blue-color\">US to set up a new unit to probe possible misuse of student work permits<\/span><\/a>]<\/h4>\n\n\n\n<p>Further, looking back upon the history of attempted <strong>immigration law reforms<\/strong>. The last major comprehensive<strong> immigration bill <\/strong>was passed by the Senate, yet not by the then Republican-controlled House. The majority of the <strong>Republican senators<\/strong> who were in favor of that bill are still active members of the Senate. These thoughts were also a part of the last failed change.<\/p>\n\n\n\n<p>The speed, <strong>efficiency<\/strong>, and expertise shown by the Biden group make it inevitable. That we will see intelligent and <strong>well-considered<\/strong> administration of laws and policy for at least the next <strong>four years<\/strong>.
