H-1B Quota Selection Rule: U.S. Citizenship and Immigration Services (USCIS<\/strong>) has made the decision to delay the implementation of the rule introducing wage-weighted priority into the H-1B lottery selection system<\/strong>. USCIS declared that it will postpone the effective date <\/strong>of the final rule named “Modification of Registration Requirement for Petitioners Seeking To File Cap-Subject H-1B Petitions<\/strong>.”<\/p>\n\n\n\n

This rule was published on 8th January 2021 <\/strong>and was planned to become effective on 9th March 2021<\/strong>. The new effective date is 31st December 2021<\/strong>, and it will not affect H-1B quota registration for FY2022<\/strong>. USCIS will publish an announcement of this delay in the Federal Register on Monday, 8th February 2021<\/strong>.<\/p>\n\n\n\n

However, the rule will change the H-1B lottery process<\/strong> to replace the random lottery with a weighted selection system favoring H-1B registrations<\/strong>. In which employers have agreed to pay the highest wage level in the Department of Labor\u2019s (DOL<\/strong>) four-tiered wage system. To be implemented, USCIS’s online H-1B quota selection system <\/strong>will have to be significantly revised to take into account the employer\u2019s offered wage. The occupational classification, and the wage level in the DOL\u2019s system<\/strong>.<\/p>\n\n\n\n
