On <strong>3rd September 2020<\/strong>, the United States DHS sent another proposed interim final rule. It &#8220;Strengthening the H1B Nonimmigrant Visa Classification Program,&#8221; to the White House&#8217;s <strong>OIRA<\/strong> (Office of Information and Regulatory Affairs). The new rule might be more difficult for employers \u2013 particularly outsourcing, staffing, and counseling organizations \u2013 to support employees on H1B visas.<\/p>\n<h2 style=\"text-align: justify;\">Interim Final Rule Likely to have Stricter H-1B Visa Eligibility Requirements<\/h2>\n<p style=\"text-align: justify;\">While the actual content of the new guideline isn&#8217;t yet available. Almost certainly, the interim final rule will formalize some of the policies that USCIS (United States Citizenship and Immigration Services) has already been utilizing to give RFE (<strong>Requests for Evidence<\/strong>) and rejections related to H-1B petitions. The policies include are as follows:<\/p>\n<ul>\n<li style=\"text-align: justify;\">Changing the meaning of &#8220;<strong>specialty occupation<\/strong>&#8221; so with the goal it mainly focuses on demonstrating the match between the job&#8217;s degree requirements, the job description, and the forthcoming employee&#8217;s specialized degree.<\/li>\n<li style=\"text-align: justify;\">Updating pay and LCA (<strong>Labor Condition Application<\/strong>) requirements to focus only on the &#8220;best and most brilliant&#8221; specialized employees.<\/li>\n<li style=\"text-align: justify;\">Restoring a few requirements for laborers at <strong>third-party worksites<\/strong>, making it harder to demonstrate the employer-employee relationship for these positions.<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\">Why DHS is Modifying H-1B Requirements<\/h3>\n<p style=\"text-align: justify;\">DHS has said it is trying to change the meaning of <strong>H-1B specialty occupation<\/strong> with the objectives of:<\/p>\n<ul>\n<li style=\"text-align: justify;\">Attracting the best and the brightest foreign nationals to the United States through the H1B program<\/li>\n<li style=\"text-align: justify;\">Protecting US laborers and wages by:<\/li>\n<li style=\"text-align: justify;\">Guaranteeing employers pay reasonable wages to H-1B workers<\/li>\n<li style=\"text-align: justify;\">Changing the meaning of employment and the employer-employee relationship<\/li>\n<li style=\"text-align: justify;\">Decreasing fraud in the H-1B program and granting visas only for truly specialized positions<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\">What\u2019s Next for H-1B Visa Regulations<\/h3>\n<p style=\"text-align: justify;\">The Office of Information and Regulatory Affairs (OIRA) has<strong> 90 days<\/strong> to survey the proposed regulation. After review and endorsement, the OIRA is expected to issue the rule in the <strong>Federal Register.<\/strong>\u00a0where it would become effective shortly thereafter. Yet, it is likely that this new rule will be inquired in court, which could delay execution.<\/p>\n<p style=\"text-align: right;\">[<a href=\"https:\/\/www.h1btransfersusa.com\/blog\/2020\/09\/21\/immigration-alert-september-2020\/\"><span style=\"color: #000080;\"><strong>Immigration Alert September 2020<\/strong><\/span><\/a>]<\/p>\n<p style=\"text-align: justify;\">The full importance of the DHS&#8217;s interim last rule is unclear until the full rule is issued, and its legal challenges are judged. Nevertheless, the new rule will likely make it more difficult for <strong>H1B employers<\/strong> to demonstrate the employer-employee relationship.
