{"id":795,"date":"2021-05-05T14:19:05","date_gmt":"2021-05-05T14:19:05","guid":{"rendered":"https:\/\/www.h1btransfersusa.com\/blog\/?p=795"},"modified":"2021-05-06T09:10:17","modified_gmt":"2021-05-06T09:10:17","slug":"us-to-suspend-biometric-requirements-for-processing-h4-ead-visas","status":"publish","type":"post","link":"https:\/\/www.h1btransfersusa.com\/blog\/us-to-suspend-biometric-requirements-for-processing-h4-ead-visas\/","title":{"rendered":"America to suspend biometric requirements for processing H4-EAD visas"},"content":{"rendered":"\n<p>The US immigration agency will <strong>suspend biometrics<\/strong> for all H4 and L2 applications (H4-EAD visas) from <strong>17th May 2021<\/strong>, said the attorneys at <strong>Wasden Banias<\/strong>, an immigration law firm.<\/p>\n\n\n\n<p>This is relied upon to help speed up <strong>processing times<\/strong> for visa extensions and employment authorization of <strong>H-1B and L1 visa holders<\/strong> in the United States.<\/p>\n\n\n\n<p>The move came in response to a <strong>class-action lawsuit<\/strong> by the American Immigration Lawyers Association (<strong>AILA<\/strong>) and Wasden Banias.<\/p>\n\n\n\n<p>&#8220;USCIS confirms it will suspend biometrics for ALL <strong>#h4 and #L2 applications <\/strong>as of 17th May 2021. In a court filing in Seattle late Monday night\u2026 This is an important initial step to restoring sanity to <strong>#H4EAD and #L2EAD <\/strong>adjudication times,\u201d the law firm Wasden Banias tweeted.<\/p>\n\n\n\n<p>The USCIS will make more data about this <strong>requirement <\/strong>available to the public in the coming days.<\/p>\n\n\n\n<h2>USCIS to suspend biometric requirements for processing H4-EAD visas<\/h2>\n\n\n\n<p>There have been<strong> serval days<\/strong> in processing the employment authorization documents (EAD) for <strong>H4 visa holders<\/strong>. More than<strong> 90% <\/strong>of whom are Indian women. &#8220;It&#8217;s difficult for the more than <strong>100,000 individuals<\/strong> who have lost work on account of government awkwardness. It is the first step in fixing this issue. However, the agency still needs to<strong> fix a system <\/strong>full of broken processing. Until we get back to the simultaneous filing of applications we will see delays persist,&#8221; said Jonathan Wasden, partner, Wasden Banias.<\/p>\n\n\n\n<p>In April, a <strong>lawsuit <\/strong>was filed against the Department of Homeland Security (<strong>DHS<\/strong>). But, there is much more that should be done to restore predictability, sanity, and faith in the <strong>H and L visa programs<\/strong>. We are hopeful this is only the first concession. Moreover, we are able to get out of our <strong>litigation efforts<\/strong>,\u201d said Bradley Banias, partner, Wasden Banias.<\/p>\n\n\n\n<p>&#8220;The delays that<strong> H-4 and L-2 non-immigrants <\/strong>are facing unnecessarily place families in financial limbo\u2026. <strong>DHS <\/strong>can and should revoke the unnecessary biometrics requirements for H-4 and L-2 non-immigrants. Give automatic work authorization while DHS processes <strong>EAD renewal requests<\/strong>. And permit EAD candidates to file their renewal applications sooner than 180 days before <strong>EAD expiration<\/strong> to prevent gaps in work authorization,\u201d Jennifer Minear, President of
