Also, this will delay the effective date of the rule by 18 months &#8211; from <strong>14th May 2021 to 14th November 2022.<\/strong><\/p>\n\n\n\n<p>As indicated by a notification by the<strong> Department of Labor<\/strong> (DOL), the additional delay has been proposed to &#8220;give an<strong> adequate amount <\/strong>of time to completely consider the legal and policy issues raised in the rule.\u201d<\/p>\n\n\n\n<p>It said this would offer the <strong>public <\/strong>a chance to give data on the sources and methods for determining <strong>prevailing wage levels <\/strong>covering employment opportunities that <strong>US employers <\/strong>seek to fill with foreign workers either permanently or temporarily through <strong>employment-based immigrant visas<\/strong> or through <strong>H\u20131B, H\u20131B1<\/strong>, or E\u20133 non-immigrant visas.<\/p>\n\n\n\n<h2>DOL delays implementing new H-1B wage levels to November 2022<\/h2>\n\n\n\n<p>The Department of Labor had welcomed comments on the proposed rule, and got <strong>627 comments<\/strong>, it said.<\/p>\n\n\n\n<p>The rule, <strong>Strengthening Wage Protections<\/strong> for the Temporary and Permanent Employment of Certain Immigrants and <strong>Non-Immigrants <\/strong>in the United States. It was presented by the past Donald Trump government on <strong>14th January 2021,<\/strong> days before the previous president left office.<\/p>\n\n\n\n<p>The government of current US President<strong> Joe Biden<\/strong> had to implement the rule. Opening it up for <strong>public comments <\/strong>and further analysis prior to continuing with it.<\/p>\n\n\n\n<h4 class=\"has-text-align-right\">[<a href=\"https:\/\/www.h1btransfersusa.com\/blog\/shift-to-wage-based-visa-selection-in-the-us-to-impact-international-students\/\" target=\"_blank\" rel=\"noreferrer noopener\"><span class=\"has-inline-color has-luminous-vivid-orange-color\">Shift to wage-based visa selection in the US to impact international students<\/span><\/a>]<\/h4>\n\n\n\n<p>The rule calls for expanding the base wages of the <strong>four wage levels<\/strong> under the <strong>H-1B <\/strong>and different programs. To be implemented in a staggered manner from<strong> July 2021<\/strong>.<\/p>\n\n\n\n<p>This would have impressively <strong>expanded salaries<\/strong>, particularly at the entry level. Making it harder for students and certain different categories of medical professionals to get jobs at those <strong>wage levels<\/strong>.
