Those employees are not &#8220;compact,&#8221; rather they are qualified to keep working for up to an extra <strong>240 days<\/strong> if the extension of stay was timely filed.<\/p>\n\n\n\n<p>Portability for workers changing employers applies if:<\/p>\n\n\n\n<ul><li>The<strong> H-2B expansion<\/strong> was received before May 25 and is pending on 25th May 2021; or<\/li><li>USCIS gets the H-2B petition between May 25 and <strong>22nd November 2021<\/strong>.<\/li><\/ul>\n\n\n\n<h2>H-2B Visas Increase And Portability<\/h2>\n\n\n\n<p>First, the new employee might be employed for up to <strong>60 days<\/strong> starting on the employment start date of the petition or <strong>25th May 2021<\/strong>, whichever is later.<\/p>\n\n\n\n<p>Second, the 60-day period starts on the Received Date of <strong>Form I-797<\/strong>, Notice of Action.
