USCIS Continues Phasing in Premium Processing for Certain I-140 Petitions
1 min readThe U.S. Citizenship and Immigration Services (USCIS) will soon start its second phase of extending the availability of phasing of premium processing services for two categories of I-140 petitions that historically have not been eligible for premium processing. In particular, the USCIS is extending the premium processing option to specific pending I-140 petitions. Filed under the EB1(c) multinational executive and manager category and EB2 national interest waiver (NIW) I-140 petitions.
Phasing of Premium Processing Expansion
The primary phase of this development of premium processing service started on 1st June 2022. As detailed in the USCIS declaration, this extension of premium processing will be phased in as follows:
- Starting 1st August 2022, the USCIS will accept form I-907 requests for premium processing for EB1(c) petitions filed on or before 1st July 2021.
- Starting 1st August 2022, the USCIS will accept form I-907 requests for EB2 NIW petitions filed on or before 1st August 2021.

Conclusion
The USCIS is expected to continue extending this service, and eventually. All EB1(c) and EB2 NIW I-140 petitions will be eligible for premium processing. As more details are released on these expansion plans, they will be posted on this blog.
