USCIS Provides Updates on Expansion of Premium Processing

Expansion of Premium Processing service will soon be available for all new and pending I-140 petitions filed under the EB1(c) multinational executive and manager category and EB2 national interest waiver (NIW) I-140 petitions, according to U.S. Citizenship and Immigration Services (USCIS). Additionally, the USCIS provided an update regarding the anticipated launch date of premium processing for students and exchange visitors.

Expansion of Premium Processing for EB1(c) and EB2 / NIW I-140 Petitions

The USCIS will begin accepting premium processing service requests (form I-907) for all EB1(c) and EB2 / NIW I-140 petitions. Including both new and pending petitions, on 30th January 2023. The USCIS began allowing premium processing requests for certain pending I-140 petitions in these two categories in June 2022, and this is the final stage of the process.

Premium Processing for Certain Students and Exchange Visitors

The USCIS expects to start phasing in in the availability of premium processing for F-1 students seeking STEM OPT extensions or optional practical training (OPT) beginning in March 2023. This option will initially only be available to STEM OPT extensions who have already filed an I-765 form by an undetermined date. The USCIS expects to offer this option to all STEM OPT and OPT applicants by April 2023.

After that, in May 2023, the USCIS expects that certain F-1 students and J-1 exchange visitors with pending applications. To extend or change their nonimmigrant status (form I-539) will be eligible for premium processing. The United States Citizenship and Immigration Services (USCIS) intends to expand this option. To include specific student and exchange visitor applicants submitting initial form I-539 applications by June 2023.
