Despite decreasing denial rates, American employers have been struggling with a worker shortage caused by the H-1B visa’s low annual limit.

According to the NFAP study, the low annual limit for H-1B petitions is currently the main issue. Facing employers attempting to secure foreign-born talent. As a result of the Trump government’s losses in federal court during Donald Trump’s final year in office. H-1B denial rates have returned to low levels.

In FY 2022, the denial rate for H-1B petitions for initial employment was 2%, and in FY 2021, it was 4%. These are the lowest levels that have been recorded since data on H-1B denial rates became available.

Employers submitted over 483,000 H-1B registrations in April 2022, exceeding the annual limit of 85,000 H-1B petitions. By almost 400,000, according to US Citizenship and Immigration Services (USCIS).

In FY 2021, H-1B visa holders’ median annual salary was $108,000, according to USCIS data. In FY 2021, the median salary for H-1B visa holders in computer-related occupations was $111,000. And the average salary in computer-related occupations was $118,000.
